ESF Apprenticeships website terms of use and registration
These Terms and Conditions govern the use of the ESF Apprenticeships website and online registration forms (the "Website" or "Platform") and the initial application for training services provided by ESF Apprenticeships, a trading name of Sporting Futures Training (UK) Ltd, or its related entities ("The Provider," "we," "us," or "our").
1. General terms and definitions
1.1. Apprentice/Learner: The individual employee who is submitting an application or registration form.
1.2. Employer: The organisation who employs or intends to employ the Apprentice and supports their application.
1.3. Services: The Apprenticeship training and assessment programmes offered by the Provider.
1.4. User: Any individual (including the Apprentice and Employer) accessing or using the Website or Platform.
1.5. ESFA: The Education and Skills Funding Agency.
2. Website use and intellectual property
2.1. Acceptance: By accessing or using the Website, the User confirms acceptance of these Terms, the Provider's [Privacy Policy](https://esfapprenticeships.co.uk/privacy-policy/), and any other [relevant policies](https://esfapprenticeships.co.uk/key-policies/).
2.2. Intellectual Property: All content, design, text, graphics, and course materials (where applicable) displayed on the Website and Platform are the property of the Provider (or its licensors) and are protected by copyright. Unauthorised use, copying, or redistribution is strictly prohibited.
2.3. Code of Conduct: Users are granted access solely for lawful purposes related to applying for or managing the Services. Users must not:
* Share their login credentials or account access with any other party.
* Post or transmit any unlawful, harassing, defamatory, or abusive material.
* Attempt to interfere with the integrity or security of the Website or Platform.
2.4. Availability: We do not guarantee that the Website will always be available or uninterrupted. We will not be liable if, for any reason, the Website is unavailable at any time or for any period.
3. Registration and application data
3.1. Accuracy of Information: Users warrant that all information provided during the registration or application process is true, accurate, and complete. Failure to provide accurate information may result in the rejection of an application or termination of a contract later on.
3.2. No Contract for Service: Submission of an application or payment of a deposit via the Website does not constitute a binding contract for the delivery of the full Services. A contract for the full Apprenticeship Programme will only be formed upon mutual agreement and signature of a separate Commitment Statement and Training Agreement.
3.3. Fees: Any published fees are subject to change until a binding contract for Service delivery is signed. Any deposits paid are subject to the terms agreed upon at the time of payment.
4. Personal data and ESFA compliance
4.1. Data Collection: We will collect and process personal data provided via the Website or registration form in accordance with our Privacy Policy.
4.2. Statutory Sharing: By submitting an application, the User explicitly consents to the Provider collecting, processing, and sharing the data necessary for the application and funding process with third parties, including but not limited to the ESFA, local authorities, funding auditors, and any relevant End-Point Assessment Organisation.
4.3. Progress Sharing: Where the Employer is involved in the application or subsequent funding, the Apprentice consents to the Provider sharing information regarding the Apprentice's application status and engagement with the Employer for administrative purposes.
4.4. Data Security: We employ appropriate security measures to protect User data but cannot guarantee the absolute security of information transmitted over the internet.
5. Disclaimers and limitation of liability
5.1. Disclaimer: The Website and all information and content on it are provided "as is," without any guarantee, condition, or warranty as to accuracy, completeness, or suitability for any particular purpose.
5.2. Third-Party Links: Links to third-party websites are provided for convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from their use.
5.3. Limitation of Liability: To the maximum extent permitted by law, the Provider, its parent company (Real Group Ltd), and associated entities hereby expressly exclude liability for any direct, indirect, or consequential loss or damage incurred by any User in connection with the Website, including loss of income, business, profits, or data. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation.
6. General provisions
6.1. Severability: If any provision of these Terms is deemed unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.
6.2. Governing Law: This agreement and any dispute or claim arising out of or in connection with it shall be governed by the law of England and Wales.
6.3. Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction over any such dispute or claim.
